Port Orchard Shoreline Master Program Approved by Department Of Ecology

On March 14, 2013, the Department of Ecology approved Port Orchard’s Shoreline Master Program (SMP) comprehensive update.

Required  DOE Changes

1. (POMC) 18.01.080 referencing “reasonable use exception”. This exception shall not apply within shoreline jurisdiction.

18.01.080 Reasonable use exception.

“If the application of the CAO would deny all reasonable use of the property, the applicant may apply for a reasonable use exception pursuant to this section”

2. Buffer Averaging…The buffer shall not be reduced by more than 25 percent.

3. Wetland Mitigation Ratios Expanded

4. Wetland Development Standard buffers expanded

  1. No “reasonable use exception” in the shoreline? That’s going to be pretty expensive for the County–is Ecology supplying the cash to buy all those properties through eminent domain? You folks are going to appeal, right?
